Hire Terms

All customers are required to accept the terms of hire at the time of picking up/receiving your hired equipment. If you have any questions or concerns about the below conditions please do not hesitate to contact us. 

DISCLAIMER: THE BELOW TERMS & CONDITIONS ARE A GENERAL OVERVIEW OF OUR CONTRACT, THE EXACT CONTRACT THAT YOU WILL RECEIVE WILL DIFFER BASED ON PRODUCTS AND SERVICES ORDERED

Order Minimum: The minimum order value is $100 for all hire orders and $200 for delivery orders. Delivery fees apply to delivery orders and acceptance of delivery orders is subject to operational capabilities. 

Terms & Conditions - SAMPLE ONLY, NOT TO BE RELIED ON

1.Hire Fees 

The Hirer agrees to pay HIRE KING the Hire Fees for the Equipment at the rates specified in the Equipment Hire Invoice from the date and time the Equipment is taken out to the date and time the Equipment is returned to HIRE KING. The Hirer pays for the entire time the Equipment is hired out not for the time the Equipment is used. Late return of Equipment will be charged at the full normal daily rate until Equipment is returned. The minimum hire period is 1 day (24 hours).

2. Security Deposit (Bond)

The Hirer may be required to leave a bond prior to being able to Hire Equipment. The bond may take the form of cash, credit/eftpos card or as a credit card pre-authorisation. The bond may be used by HIRE KING to pay for any late fees, other charges or as payment for lost, stolen or damaged equipment. The Hirers liability for any lost, stolen or damaged equipment will be for the total cost of the equipment and is not limited to the bond amount.

3. Taxes, Stamp Duty and Government Charges

The Hirer agrees to pay HIRE KING all and any appropriate taxes, stamp duty and government charges in addition to the Hire Fees. If a goods and services tax or similar value added tax ("GST") is levied in respect of any taxable supply made under or in connection with this Contract the amount payable for that supply will be increased by the rate of GST and shall reflect any reduction in or abolition of any existing taxes.

4. Insurance 

The Hirer is responsible for procuring their own insurance for the full value of the Equipment in the case of loss, theft or damage during the hire period. No insurance is offered by HIRE KING. Clients are are 100% responsible for complete replacement/repair costs of damage, lost or stolen Hire Equipment

5. Use of Equipment

The Hirer shall use the equipment for purpose(s) for which is designed for and agreed to at the time of hire. If the equipment is used in a negligent, unskilful or improper manner, or in a manner other than that for which the Equipment was intended or constructed (or if the Hirer leaves the Equipment unattended), and the equipment is thereby lost or damaged, then the Hirer shall be liable to HIRE KING for any such loss or damage. The HIRER understands that all equipment will be tested and checked once returned and The HIRER has the right to be there while the equipment is being tested. HIRE KING should be notified at the time of return if you wish us to test the equipment in front of you. If any equipment is not working or damaged the HIRER will be liable for the full replacement cost or repair cost, whichever is deemed fit by HIRE KING.

6. Freight / Delivery / Installation 

The Hirer agrees to pay all freight, delivery, transportation, shipping, postage and courier costs whether incurred by the Hirer or HIRE KING in respect of the delivery and/or return of the Equipment. HIRE KING is not liable for any delays in delivery of Equipment.

7. Payment

HIRE KING usual credit terms apply to all Hirers who have a credit account with HIRE KING. For Hirers who do not have a credit account, all fees and charges payable under this Contract must be paid in advance and Hirer agrees to provide full contact details, proof of address and a credit card imprint. The Hirer agrees to any additional costs and payment in full within credit terms for any additional freight and delivery costs incurred and any additional Hire Fees and other charges incurred as a result of late return Equipment.

8. Ownership of Equipment

The Equipment shall at all times remain the property of HIRE KING. The Hirer agrees not to sell, transfer licence, loan, hire or give the Equipment to any one or to part with or share possession of the Equipment or do anything which may effect HIRE KING interest in the Equipment. If the Equipment is hired on to a third party by the Hirer - it remains the responsibility of the Hirer for the condition and return of equipment.

9. Cleaning - IMPORTANT

At the end of the hire period and before returning the Equipment to HIRE KING, the Hirer agrees to properly clean the Equipment. The Hirer agrees to pay for any cleaning costs incurred by HIRE KING in the event the Hirer fails in its cleaning obligations. HIRE KING may deduct such costs from the Hirer's deposit or credit card. Indicative cleaning fees (per piece): Chairs-$1, Tables-$2, Chafing dish-$5, Urn-$10, Carpet vacuum-$25, Carpet shampoo-$50, Pie warmer-$10.

10. Breakdown

In the event of a breakdown of the equipment during the hire period, the Hirer shall report the Equipment to HIRE KING immediately and shall on no account repair or attempt to repair the Equipment without the prior consent of HIRE KING. HIRE KING should be notified immediately by phone/sms in the case of a breakdown on our emergency numbers 0417930386 or 0403311454.

11. Liability

Where permitted by Australian Consumer Law Schedule of the Competition and Consumer Act ('The Australian Consumer Law') HIRE KING shall not be liable to the hirer or any third party in respect of any loss or damage however caused arising directly or indirectly from the hire of the Equipment. HIRE KING liability if any is limited to a refund of the Hire Fees charged for such Equipment. All other excludable warranties whether express or implied are excluded. The Hirer indemnifies or holds harmless HIRE KING from all and any liability, losses, damage, claims, demands and expenses of any kind however caused arising directly or indirectly from this Equipment Hire Contract.

12. Reservations, Cancellations & Returns 

A $50 admin fee will apply to all bookings that are cancelled more than 14 days prior to the hire date. Any bookings cancelled within 14 days of the hire date will incur 50% of the total hire charges or $50, whichever is higher. Bookings cancelled within 24 hours of the hire date or no-shows will be charged 100% of the hire charges. If equipment is not returned on the day of return then hire charges will apply based on the normal daily hire charges. If equipment is not returned within 3 business days of the return date HIRE KING at their discretion may charge the amount for the cost of the equipment.

13. Termination

The Equipment Hire Contract may be terminated immediately by HIRE KING if the Hirer breaches any term of this Contract.

14. Free of Charge Issue

Where equipment is supplied by HIRE KING on a free of charge basis, these terms and conditions still apply.

15. General

HIRE KING reserves the right to amend the terms and conditions of this Equipment Hire Contract at any time
- I have received the above mentioned goods in an undamaged and good working condition.
- I understand that I am liable to pay for any lost, damaged or stolen equipment.
- I understand that I must immediately report any damaged or not working equipment prior to use to (REFER TO YOUR CONTRACT) by phone/SMS - at any time of the day.
- I understand that all equipment must be returned in a clean condition, failure to do so will result in a cleaning fee being charged.
